By accessing or using Bladdit ("we," "our," or "us") at bladdit.com (the "Site") and our AI image generation services (the "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Services.

These Terms constitute a legally binding agreement between you and Bladdit regarding your use of the Site and Services. We reserve the right to modify these Terms at any time, and such modifications will be effective immediately upon posting.

2. Description of Services

Bladdit provides free AI-powered image tools, including:

• AI Image Generation: Create original images from text prompts using artificial intelligence technology.
• Background Removal: Automatically remove backgrounds from uploaded images to create transparent cutouts.
• Image Enhancement: Upscale and improve the quality of existing images using AI technology.

Our Services are provided "as is" and we make no guarantees regarding availability, accuracy, or specific outcomes of generated content.

3. Eligibility

You must be at least 13 years of age to use our Services. If you are under 18, you represent that you have obtained parental or guardian consent to use our Services. By using our Services, you represent and warrant that you have the legal capacity to enter into these Terms.

4. Acceptable Use Policy

You agree to use our Services only for lawful purposes. You may NOT use our Services to create, upload, or distribute content that:

• Is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable
• Contains sexually explicit or pornographic material

We reserve the right to refuse service, terminate access, or remove content at our sole discretion for any violation of these Terms.

5. Intellectual Property Rights

Your Rights to Generated Content

Subject to these Terms and applicable law, you retain rights to use images you generate through our Services for personal and commercial purposes. You may:

• Use generated images for personal projects, social media, and marketing
• Sell products featuring your generated images
• Use generated images in commercial projects and publications

Note: AI-generated images may not be eligible for copyright protection in certain jurisdictions. We make no guarantees regarding copyright status.

Our Intellectual Property

The Site, including its design, features, content (excluding user-generated content), and underlying technology, is owned by Bladdit and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Services without prior written consent.

6. User Uploaded Content

When you upload images to our Services for processing:

• You represent that you own or have the right to use the uploaded content
• You grant us a limited, non-exclusive license to process your content solely to provide our Services
• We do not claim ownership of your uploaded content
• Uploaded images are deleted after processing

7. Disclaimer of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement
• Guarantees that our Services will be uninterrupted, secure, or error-free
• Warranties regarding the accuracy, quality, or reliability of generated content
• Guarantees that results will meet your specific requirements or expectations

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BLADDIT AND ITS AFFILIATES, OFFICERS, DIRECTORS, AND EMPLOYEES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF OR INABILITY TO USE OUR SERVICES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE PAST 12 MONTHS, OR $100, WHICHEVER IS LESS.

You agree to indemnify, defend, and hold harmless Bladdit and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including legal fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) content you create, upload, or distribute through our Services; or (d) your violation of any rights of third parties.

Our Services may contain links to third-party websites or services that are not owned or controlled by Bladdit. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party services. You acknowledge and agree that we shall not be responsible for any damage or loss caused by your use of third-party services.

11. Service Modifications

We reserve the right to modify, suspend, or discontinue any aspect of our Services at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of our Services.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Bladdit operates, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the courts of that jurisdiction.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
